The Fair Work Commission now has the power to make anti-bullying findings and orders, and a real estate agency has recently been the subject of the Commission’s first anti-bullying order.

In this case, the applicants alleged that their manager had bullied them in ways such as belittling, swearing, and physical intimidation. The case was successful, and the order now prevents both parties from contacting each other, and the company must also now undertake anti-bullying training, and update their anti-bullying policies and procedures.

Cases like this highlight the need to have the correct and appropriate policies in place in every business, and also determine what appropriate workplace behaviour constitutes.
